These General Terms of Sale govern the offer and sale of products on the foogola.com website, owned by Alicos S.r.l. Purchasing products implies full acceptance of these terms.
01General provisions
Anyone who makes purchases through the site is considered a customer. These terms govern all sales made through the website, by phone, or by email. The user must read and accept these terms before proceeding with a purchase. The Company reserves the right to modify these terms at any time.
02Scope
These terms govern offers, orders, and acceptance of purchase orders for products sold on foogola.com.
03Site registration
Registration with username, password, and email address may be required to make purchases. The user is responsible for keeping their credentials confidential and for all activity carried out with their account. Unauthorized use must be reported promptly. The Company may block accounts in case of violations.
04Contract conclusion
The purchase contract is concluded when the user confirms and submits the order. The order contains product information, price, payment methods, delivery details, and shipping costs. The Company will send an order confirmation email.
05User obligations
The user must provide correct and up-to-date personal data during registration and purchase. In case of inaccurate or incomplete information, the Company may suspend the service.
06Products
Product availability is indicative and may change in real time. If a product becomes unavailable after order confirmation, the user will be notified promptly. Refund within 5 days in case of cancellation due to unavailability. Product images may differ slightly from reality.
07Prices
Prices shown on the site include VAT and do not include shipping costs. Prices may change at any time, but confirmed orders will be fulfilled at the original price. Accepted payment methods: PayPal, credit/debit card, bank transfer.
08Invoicing
Each order is accompanied by an invoice or fiscal receipt. Copies can be requested by email or downloaded from the customer's personal area.
09Order acceptance
An order is binding only upon completion of the procedure without errors. A confirmation email is automatically sent to the user.
10Order cancellation
The user may cancel the entire order within one hour of submission. Later cancellation requests are subject to evaluation. To cancel, contact customer service with the order reference number.
11Delivery
Shipping is available within Italy and internationally. The courier makes two delivery attempts. Shipping costs are borne by the buyer unless otherwise indicated.
12Right of withdrawal
The right of withdrawal applies to the entire product. Refund within 14 days of receiving the withdrawal notice, using the same payment method. Products must be returned in original packaging. The right of withdrawal is excluded for food products (including beverages) as they are subject to deterioration, and for sealed products opened after delivery, pursuant to Art. 59 of the Consumer Code.
13Privacy
Personal data is processed in accordance with EU Regulation 2016/679 (GDPR). For more details, please refer to the privacy policy available on the site.
14Disclaimer
Information on the site is general and informational in nature and does not constitute medical advice. The Company is not responsible for consequences arising from improper use of published information.
15Intellectual property
All site content (design, text, graphics, images, software) is the exclusive property of the seller. Reproduction, copying, or distribution of content is prohibited without written authorization. No trademark rights are granted to the buyer.
16Force majeure
The Company is not liable for delays or non-deliveries due to circumstances beyond its control, including strikes, wars, natural disasters, and other force majeure events.
17Severability
If any provision of these terms is found to be invalid, the remaining provisions shall remain in full force and effect.
18Jurisdiction
These terms are governed by Italian law. The Court of Trapani has jurisdiction over any disputes, pursuant to Italian Legislative Decree 185/99 on distance selling.
19Access and storage
Pursuant to Italian Legislative Decree 70/2003, orders are stored in digital and/or paper format. Users may access the general terms, legal notices, and privacy policy at any time on the site and may save or print them.
